Terms of Service

I, (the client) agree to pay Chromolume, Inc. (the vendor) for any and all transcription work performed on my or my company's behalf. I have reviewed the rates and am fully aware that I am responsible for an accurate and truthful description of the audio contained on the audio source.

I agree and understand that the "vendor" does not charge for difficult audio and that I will be informed upfront should an audio be considered "undoable." I also understand that should an audio be difficult to transcribe, yet "doable," there will be blanks in the transcript, and because there is no extra charge for difficult audio, I will accept the work with the blanks.

Chromolume, Inc. has the right to reject any audio that is considered to be of such poor quality that: (1) transcription is not possible or (2) project is beyond company's resources. Our company also reserves the right to reject any project for any reason. If the audio quality of any project appears to be different than the quality presented by client, the company will contact the client and discuss the issue.

I may submit masters of my original audio at my own risk. While Chromolume, Inc. digitizes and copies all audio we receive (at no charge), we make no guarantees that the tapes will be free from damage during the shipping process. Client agrees to not hold Chromolume, Inc. liable for loss or damages to audio sources that may occur in shipping or transmission electronically.

Client agrees to pay all shipping costs for submission and return of original audio files that are not digital files. Chromolume, Inc. will always give client different shipping options, but when one is not selected, our company will send it back in the most affordable way possible.

If client feels that work performed by our company is not up to acceptable industry standard, then he or she will contact us in writing within one (1) week of receipt of said transcripts. Burden of proof rests with the client, and client realizes and accepts that no transcript is ever "perfect." Judgment calls have to be made on punctuation, spellings, grammar, etc. If accuracy rate is below industry standard and corrections cannot be made, Chromolume, Inc. will offer a partial refund to client. Client acknowledges that Chromolume, Inc. bills per minute of recorded audio and not on page count, number of characters, or work hours. Any additional seconds that do not make up a full 60 seconds are billed as an extra minute.

While we strive for above-industry standard accuracy rate or better for audio that is well recorded, client agrees to release and hold harmless Chromolume, Inc., it's officers, and employees of any damages that may occur from the publication, quotation, distribution, or public use of a quotation from the transcript that may contain a typographical or factual error or even quotations that are without error. Client agrees that it is his or her responsibility to confirm the accuracy of a transcript before information from a transcript is published or printed and will not list or imply Chromolume, Inc., it's officers, or any employees as a defendant in any litigation or ongoing legal cases.

Client acknowledges that checking the box, "I agree that I have read and will abide by the Terms of Service agreement listed on this site" binds client to the terms of service listed in this article. Chromolume, Inc. may change this Terms of Service agreement on occasion. Any modifications made to it can be found on the Chromolume, Inc. website.
